The company, Active World has its registered office at Berhampore, Murshidabad, West Bengal - 742101.
Its main business is selling or offering goods or services using a direct selling model.
This instrument hereafter referred to as the agreement executed between the applicant/direct seller and the company. (Here the company means Active World and its official website).
The company is engaged in the business of direct selling through multi-level marketing (MLM) and in other business activities as stated in the object clauses of the Memorandum and Articles of Association of the company.
The Company authorizes direct sellers across India for marketing and sale of its products and services.
There are no fees or charges for becoming a direct seller of the company.
The applicant must be 18 years of age or above.
Active World exclusively uses its website to display the details of the products, marketing method and business monitoring.
Active World also uses verbal publicity to promote its business.
The applicant should go through the official website of Active World and read related documents including stipulated terms and conditions for becoming a direct seller.
The direct seller must clearly understand and agree to abide by the terms and conditions as laid down herein at the time of agreement.
Every direct seller has a unique identification number and password issued by the company for direct selling of goods/products and services of the company.
The direct seller shall enjoy the following privileges:
Bonus for affecting the sale of the goods/products and services of the company as per the marketing plan.
No territorial restrictions to sell the goods/products and services.
Incentive of direct seller shall be in proportion to the Sales Volumes of the direct seller either by his/her personal efforts or through team as per the marketing plan of Active World.
Direct sellers have the option of buying back or returning currently marketable goods purchased by him/her within 30 days from the date of purchase on direct seller's request on reasonable terms.
The return of the products must be supported with the bill of purchase and such products should not be damaged in any way and should have resale value.
The purchaser should ensure that the quality and condition of the product should be similar to the quality and condition which prevailed at the time of purchase.
Such returns shall be governed by the return policy published on the official website of the company.
If any direct seller loses his/her contractual capacity due to any reason or in case of death of the direct seller, either his/her nominee or one of the legal heirs with written consent of all legal heirs may join the company as direct seller in place of the incapable direct seller.
In case of failure to arrive at such consent within six months from the incapability or death of the direct seller, the company shall be at liberty to terminate the unique ID and for this period the company will keep the unique ID in abeyance.
Direct sellers shall not manipulate the company's marketing plan, products and services, rate, S.V., R.P. etc. in any way.
Direct sellers shall not send or otherwise communicate on behalf of the company without due authorization of the company.
Direct sellers shall not use the Active World trademark, logo and design anywhere without written permission of the company.
Direct sellers shall be self-responsible for all arrangements, expenses and permissions from Central/State Government and local bodies for conducting meetings or seminars.
Direct sellers have to carry their identity card (ID) issued by the company and should not visit consumer premises without prior authorization.
He/she shall not use the ID card apart from the company's business purposes.
Direct seller or his/her relatives (dependent son or daughter, father/mother, spouse) shall not engage in any activities of multi-level marketing of any other company. If found, such direct seller shall be terminated.
Active World may terminate direct seller ID:
For unethical or prejudicial work, or if any misleading/wrong/false information is given by the direct seller.
If the direct seller does not purchase any product for a period of ninety days to one year from the date of joining.
Notwithstanding anything stated or provided herein, the company shall have the power and discretion to modify, alter or vary the terms and conditions in any manner as the company deems fit and proper and the same shall be communicated through the official website.
If any direct seller does not agree to such modifications/alterations, he/she may terminate the agreement within thirty days of such publication by giving written notice to the company.
If the direct seller continues business activities without objection after such modifications/alterations, it shall be deemed that he/she has accepted all such modifications/alterations for future purposes.
